1. USING THE WEBSITE
ALMAGEA’s website (www.almagea.hr) may be used for your private purposes without any usage fees. By using the website www.almagea.hr (“website”) and the online shop (“online shop”) you agree to abide by these General Terms and Conditions of Sale (“General Terms and Conditions”).
Please read these General Terms and Conditions carefully before using the Website or online shop or before ordering products from Almagea® d.o.o. electronically. When you visit our Website for the purpose of obtaining information about products, or access the products through the online shop, or order our products electronically, it will be considered that you are familiar with these General Terms and Conditions and that you agree with them. In case you do not agree with these General Terms and Conditions, please do not use our website for the purpose of purchasing products or to obtain information about them, nor order our products electronically from Almagea® d.o.o. Instead, make a personal visit to our partners, where you will be attended to by competent staff, providing you with all the necessary information, and where you will be able to purchase the products on sale. You’ll find a list of our partners in the Where to buy section..
These General Terms and Conditions shall also have the effect of the pre-contractual notification, pursuant to Article 57, Secton 1 of the Consumer Protection Act (Official Gazette no. 41/14, 110/15, 14/19).

2. TERMS OF PURCHASE
By ordering products from Almagea® d.o.o. electronically and/or browsing the online shop it will be understood that you are familiar with these General Terms and Conditions and the applicable product prices published on www.almagea.hr/dietary supplements, and that you accept them. Almagea® d.o.o. is not responsible for any disputes that may arise due to the fact that you have not read the General Terms and Conditions.
The steps, as well as the conditions of purchase/sale of products electronically and/or through the online shop are defined by the following parameters: order, shipping, payment, delivery, complaints.

Almagea® d.o.o. makes it possible for customers to purchase products in the online shop, and by ordering by email to almagea@almagea.hr. For the purposes of these General Terms and Conditions, a customer is taken to be any person who electronically orders at least one product, or places and order in the online shop, filling in the required information in the registration form. All product prices are stated in Croatian kuna (HRK), including VAT.
3. ORDERING PRODUCTS
Products are ordered electronically, by email or through the online shop.
When you order products by email, the goods will be considered ordered from the point when Almagea® d.o.o. receives the order. You will receive a confirmation sent to your email address, telling you that the order has been received. The confirmation about your order’s receipt will contain the products you ordered and the total price as well as a link to these General Terms and Conditions, which means that Almagea® d.o.o. has fulfilled its obligation to deliver the contract to the customer. If you do not receive this confirmation, consult the Contact section, and reach out to us.
The shopping process in our online shop begins by selecting the ADD TO CART option. This will automatically save the selected product in the cart. You can purchase the products saved in the cart as a guest or as a registered user, but after you had entered the customer data (billing data) and delivery address. These data will automatically appear in the cart when you select the Add to cart option. The goods are considered ordered when the customer had completed the entire ordering process. You will receive a confirmation to your email address you registered with as a customer that the order has been received. The order’s receipt confirmation will contain the products you ordered and the total price as well as a link to these General Terms and Conditions, which shall mean that Almagea® d.o.o. has fulfilled the obligation to deliver the contract to the customer. If you do not receive this confirmation, please check if the ordered products are in your cart after registration. If the cart is empty, please consult the Contact section, and reach out to us.
Almagea® d.o.o. undertakes to deliver all the ordered products. If Almagea® d.o.o. shall not able to deliver any of the ordered products, the total price of the order will be reduced for that product, of which you will be notified with the aforementioned order confirmation. All the remaining products will be delivered.
4. ONLINE SHOPPING PURCHASE OPTIONS
When ordering a product in the online shop, the customer shall choose between a one-time purchase, by selecting the Add to cart option, and a subscription, by selecting the Subscribe option.
One-time purchase
A one-time purchase means a one-time order of one or more products.
The price of the product in a one-time purchase shall include the price of the products stated in the order, as published in the online shop (www.almagea.hr/dietarysupplements), including VAT (“standard price”). Import duties, customs clearance costs, taxes and fees related to the import of products are not included in the standard price. The customer shall have to check additional costs prior to the order.
Subscription
The subscription relationship is established by ordering one or more products using the Subscribe option, and shall be binding from the day the customer receives the confirmation of having made such an order, until the expiration of the selected subscription period. The subject of the subscription contract is the shipment and delivery of products determined in the subscription by Almagea®d.o.o. against payment of the appropriate fee (subscription price) by the customer.
The customer shall choose the length of the subscription period by choosing between one of the options offered in the shop online.
By subscribing, the customer shall get a discount on the regular price of all the products included in the subscription as well as their delivery free of charge. The discounted amount on the regular price of the product depends on the chosen length of the subscription period.
The subscription price shall include the discounted price of all the products in the subscription, including VAT. Import duties, customs clearance costs, taxes and fees related to the import of products are not included in the subscription price. Customers shall have to check prior to their order, whether additional costs apply, and at what amount.
The subscription agreement shall end upon the expiration of the selected subscription period.

5. PAYMENT
The customer shall pay for the products at the price specified in the order confirmation.
In the case of a one-time purchase, the customer shall pay for the ordered products by any of the following options:
- debit card
- credit card
- cash on delivery
- payment order.
If a subscription contract has been concluded, then the customer shall pay for the subscribed products by the following options:
- debit card
- credit card.
The subscription is paid monthly, before the products are shipped to the customer, and it includes all products which will be delivered to the customer during each month of the subscription period.
All prices are stated and shall be paid in HRK.
Except in the case of a subscription or purchase of two or more products on a single occasion, the cost of delivery shall be additionally charged to the price of the product, according to the Delivery Price List which you can find below

6. SHIPMENT
The ordered products will be arranged and protected in such a way as to prevent possible damage during transport. Upon accepting the ordered products, the customer shall check for possible damage and immediately report it to the delivery person, and then return the delivered products which show obvius faults/damage. Complaints thereafter will not be accepted.
7. PRODUCT DELIVERY
The term “product delivery” means handing over the products listed on a single order or those whiche were chosen to form a subscription contract to the customer or a third party determined by the customer.
We shall deliver all ordered products with the agreed courier service. The delivery price shall vary depending on the value of the ordered goods.
In the event that the customer for any unjustified reasons refuses to receive the delivered products, or does not pick them up from the contracted courier service, the the product shall be brought back to Almagea ‘s address. Almagea® d.o.o. shall have the right to charge the customer the return costs in accordance with the valid price list for the costs incurred, by sending an invoice to the customer asking for payment of the above mentioned costs, payable within 15 days.

8. COMPLAINT AND RETURN POLICY
In case of product return, the buyer is obliged to send a justified complaint to the supplier. The customer has the right to return the product in the following cases:
- delivery of products that are not ordered or included in the subscription
- delivery of a product that has a defect or damage
- if the consumer's right to return the product is prescribed by coercive regulations.
Please compare the received items with the invoice and if something is missing, notify your courier immediately.
9. QUERIES AND CLAIMS
In case you have a query or a claim regarding the products in sale you purchased electronically (through the online shop and by sending an e-mail), please send it to almagea@almagea.hr. Almagea® d.o.o. will answer your query or claim as soon as possible, and take all reasonable steps to eliminate the reasons which made you send the query or claim.
10. UNILATERAL TERMINATION OF THE CONTRACT
The customer has the right to unilaterally terminate the contract on the purchase of the product/subscription online or by sending an e-mail to almagea@almagea.hr within 14 days from the date of the delivery of the products ordered on a single occasion or, in the case of a subscription, from the date of the product’s first delivery. The customer can do the above without giving any reason (“unilateral termination of the contract”). Upon expiration of the specified cancellation period, the customer loses the right to unilateral termination of the contract.
In the event that one and the same delivery includes more quantities of products that are delivered to the customer separately or in several shipments, the deadline for the unilateral termination of the contract shall begin on the day of the delivery of the last shipment. In the case of a subscription, all products delivered to the customer meant for a particular month within the subscription period are considered part of the same delivery.
The customer shall exercise his right to unilateral termination of the contract by sending a clear and unambiguous written statement to Almagea® d.o.o. before the term for a unilateral termination expires. The statement shall be sent by registered mail to Almagea’s registered officeo or to the e-mail address almagea@almagea.hr, which shall state the customer’s name and surname, address, contact telephone number or e-mail address, date of order or subscription and name and quantity of products over which the customer exercised the right to unilateral termination of the contract. You may also use the template form available at Statement of unilateral termination to initiate unilateral termination of the contract.
Almagea® d.o.o. shall without delay acknowledge receipt of the customer’s statement by sending an e-mail to the e-mail address specified by the customer in the statement of unilateral termination of the contract or, if the customer did not specify it in the statement of unilateral termination, to the customer’s e-mail address specified on ordering the product.
In case of the unilateral termination of the contract, the parties shall not be obliged to fulfill their obligations under the terminated purchase agreement/subscription contract, ie they are obliged to return to each other everything they received arising from the contract unilaterally terminated by the customer.
The customer must return the product without delay, and no later than 14 days from the notice of termination given in accordance with these General Terms and Conditions. The customer shall bear the direct costs of returning the product to the address of Almagea’s registered office. The customer shall be considered to have fulfilled the obligation to return the product on time, if the product is returned before the expiration of the aforementioned period to Almagea’s registered office, followed by an e-mail sent to almagea@almagea.hr, or if the product is delivered in person to Almagea’s registered office. The customer shall be made liable for any damage to the product resulting from the customer’s handling of the product beyond what would be reasonable to examine it.
Almagea® d.o.o. shall reimburse the consumer after the consumer has returned the product, or after the consumer submits evidence to almagea@almagea.hr of having sent the products back to the address of Almagea’s registered office, if the evidence in question was submitted before the receipt of the product.
If the product is returned with faults, major damage or without parts and documentation, and not delivered within the additional period of 8 days, the consumer shall be considered not to have fulfilled its obligation to return the product and Almagea® d.o.o. shall then have no obligation to issue the refund.
Almagea® d.o.o. shall not reimburse additional costs resulting from the customer’s explicit choice of transportation method, which differs from the standard transportation method for products purchased electronically.
Almagea® d.o.o. shall refund by using the same method of payment as the customer upon purchasing, unless the customer explicitly agrees to other methods of payment and if the customer is not obliged to pay additional costs for such a refund.
The customer is not entitled to unilateral termination of the contract if:
- Almagea® d.o.o. has entirely fulfilled the contract, and the fulfillment began with the explicit prior agreement of the customer to being fully aware of the fact the possibility of loosing the right to unilateral termination of the contract if the contract is fully fulfilled
- subject of the contract is for goods or services whose price depends on changes in the financial market that beyond the influence of Almagea® d.o.o., and which may occur within the term of the customer’s right to unilateral termination of the contract
- the subject of the contract is a product made to the customer’s specification or made to the customer’s measure
- the subject of the contract is a perishable product or a product with short shelf life
- subject of the contract are sealed goods which due to health or hygiene reasons are not suitable for return, if they were unsealed after delivery
- any of the reasons have been fulfilled owing to which the customer shall have no right to unilateral termination in accordance with the Consumer Protection Act.
11. LIABILITY FOR (MATERIAL) DEFECTS
Almagea®d.o.o. shall be responsible for the material defects of products purchased in the online shop or electronically in accordance with the Law on Obligations and the Law on Consumer Protection, which are both valid in their entirety.
12. DISPUTE RESOLUTION
In the event of a dispute arising out of or in connection with the purchase of products through the online shop or electronically, an application may be submitted to the Court of Honour of the Croatian Chamber of Commerce or a proposal for conciliation at conciliation centers, in accordance with the rules of procedure of these bodies.
13. PERSONAL DATA PROTECTION
Almagea® d.o.o. shall undertake to protect the privacy and confidentiality of its customers’ and website users’ personal data, including the data entered in the online shop.
Almagea®d.o.o. as the data processing manager, shall collect only those personal data that customers/users submit themselves, which are necessary to achieve the purpose for which they were given. The collected personal data shall be used for the purpose of selling products through the pnline shop or electronically, delivery of purchased products, answering customer/user queries, contacting customers/users and improving our products and services, as well as for other similar purposes. By submitting your personal data, you declare your consent to their collection, processing, use and, where an adequate level of personal data protection is guaranteed, forwarding in accordance with the purpose for which they were provided to us, in accordance with positive national regulations.
All collected personal data shall be strictly kept and available only to employees and business partners who need this data for the aforementioned purposes. All employees and business partners are responsible for respecting the Protection Principles relating to privacy and personal data.
If you have provided your personal data with us, you have the right to access and correct it, as well as other rights guaranteed by the General Data Protection Regulation. 14. REGISTRATION
You can register in the online shop and purchase products through it as a guest or by creating a user profile, selecting the “My Profile” option. To register, you must be at least 18 years old and have legal capacity. The customer shall be responsible for the accuracy and completeness of the data entered in the registration form. If you change the information you entered during registration, you are required to update your account to notify us of any changes.
15. SECURITY
When registering in the webshop, you will be required to create a username and a password that you must preserve, and not share with other people. You are responsible for all the actions and orders made with your password. You must notify us, if you know or suspect that someone else has been using your password.
16. CHANGES
Almagea®d.o.o. reserves the right to change these General Terms and Conditions. Almagea will inform all registered users about the changes to the General Terms and Conditions by sending out e-mails to the e-mail addresses entered by customers upon registration. If you do not agree, and do not accept these General Terms and Conditions, please contact us by e-mail. In the meantime, do not use the Almagea’s online shop services, or try to order our products by e-mail.
17. ONLINE SHOP
Almagea®d.o.o. strives to provide you with the best possible service, but we cannot guarantee that it will suit your needs. In addition to that, Almagea cannot guarantee that the service will be performed without possible errors. If an error occurs, please report it by e-mail to almagea@almagea.hr, so that we can eliminate it as soon as possible. Access to Almagea’s online shop may sometimes be unavailable due to site maintenance.

If any of the links on the website shall take you to another page, Almagea® d.o.o. shall not have control over the content of it, and shall not be responsible for its content.
