Our general conditions of sale will provide you with all the necessary information before making a purchase so that the process and experience of online shopping with us is transparent, more understandable, easier and simpler. Please read the information below carefully.
The ALMAGEA website (www.almagea.hr) can be used for your private use without any usage fees. By using the website www.almagea.hr (“Website”) and the online store www.almagea.hr/shop (“Online Store “) you undertake to comply with these General Terms and Conditions of Sale (“General Terms and Conditions of Sale”).
Please read the contents of the General Conditions of Sale page carefully before using the website or online store, or before ordering products from Almagea d.o.o. electronically. When you visit our Websites for the purpose of product information or purchase our products via the Online Store or order our products electronically, you are deemed to have read and agree to these General Terms and Conditions. In the event that you do not agree with these General Terms and Conditions, please do not use our website for the purpose of purchasing products or obtaining information about them, or that Almagea d.o.o. you do not order our products electronically, but for this purpose you visit our parterres in person, where the professional staff will give you all the necessary information and where you can purchase products from our sales range. These General Terms and Conditions also have the effect of a pre-contractual notice from Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette No. 41/14, 110/15, 14/19).

By ordering products from Almage d.o.o. by electronic means and/or by using the Internet store, it is considered that you are familiar with these General Terms and Conditions and the valid product prices published on the page Food Supplements and that you accept them . Almagea d.o.o. is not responsible for disputed issues that may arise due to the fact that you have not read the General Terms and Conditions.
The procedure, as well as the conditions of buying/selling products electronically and/or through the Internet store, are defined by the following parameters: order, shipment, payment, delivery, complaint of goods.

Almagea d.o.o. allows customers to purchase products listed in the Online Store via the Online Store and through an order sent by email to almagea@almagea.hr. In terms of these General Terms and Conditions, any person who orders at least one product electronically, and in the case of a purchase through the Internet Store, and fills in the required information in the registration form, is considered a customer. All product prices are expressed in kunas (KN) with VAT included.
Products are ordered electronically, by e-mail or via the Internet store.
In the case of ordering products by e-mail, the goods are considered ordered at the moment when Almagea d.o.o. receive the order. You will receive a confirmation that the order has been received at the email address from which you sent the order. The confirmation of receipt of the order contains the products you ordered and the total price of the order, as well as a link to these General Terms and Conditions, which means that Almagea d.o.o. fulfilled the obligation to deliver the contract to the customer. If you do not receive such a confirmation, please contact us in one of the ways listed in the Contact menu.
The purchase of a product via the Online Store begins by selecting the Add to cart option, which automatically saves the selected product to the cart. The purchase of products saved in the basket is possible as a guest or as a registered user, after entering the customer data (billing data) and the delivery address, which will be automatically displayed in the basket, by selecting the Add to basket option. The goods are considered ordered at the moment when the customer completes the entire order process. You will receive a confirmation that the order has been received at the email address you registered with as a customer. The confirmation of receipt of the order contains the products you ordered and the total price of the order, as well as a link to these General Terms and Conditions, which means that Almagea d.o.o. fulfilled the obligation to deliver the contract to the customer. If you do not receive such a confirmation, please check whether the ordered products are in your basket after registration. If the shopping cart is empty, please contact us in one of the ways listed in the menu Contact.
Almagea d.o.o. undertakes to deliver all ordered products. If Almagea d.o.o. is unable to deliver any of the ordered products, the order will be reduced for that product, which you will be informed about via the previously mentioned order confirmation. All other ordered products will be delivered.
When ordering a product through the Online Store, the customer chooses between a one-time purchase, by selecting the Add to cart option, and a subscription, by selecting the Subscribe option.
A one-time purchase means a one-time order of one or more products.
The price of the product during a one-time purchase includes the price of the products included in the order, as published on the online store Food supplements, including VAT (” regular price”). Import duties, customs clearance costs, taxes and fees related to the import of products are not included in the regular price, but customers are obliged to check whether they exist and, if so, in what amount.
The subscription relationship is established by ordering one or more products with the use of the Subscribe option, and is binding from the day when the confirmation of receipt of such order is sent to the customer until the end of the selected subscription period. The subject of the subscription contract is the delivery and delivery of the products included in the subscription by Almagea d.o.o., with payment of the corresponding fee (subscription price) by the customer.
The customer chooses the duration of the subscription relationship by choosing from one of the options offered on the Online Store.
With the subscription, the customer gets a discount on the regular price of all products covered by the subscription, as well as free delivery of the products covered by the subscription. The amount of the discount on the regular price of the product depends on the selected duration of the subscription.
The subscription price includes the discounted price of all products included in the subscription, including VAT. Import duties, customs clearance costs, taxes and fees related to the import of products are not included in the subscription price, but customers are obliged to check whether they exist and, if so, in what amount.
The subscription contract ends at the end of the selected subscription period.
In order to successfully subscribe to the product, you need to log in to My Profile on the Almagea website.
The customer pays for the products at the price specified in the order confirmation.
In the case of a one-time purchase, the customer pays for the ordered products in one of the following ways:

The subscription fee is paid monthly, before the products are shipped to the customer, for all products delivered to the customer during each month of the subscription period.
All prices are expressed and paid in euro.
Except in the case of subscription or purchase of two or more products within one order, the delivery cost is additionally charged to the product price, according to the delivery price list which you can find on the page More about the method of payment and delivery.
The ordered products will be folded and protected to prevent possible damage during transport. When picking up the ordered products, the customer is obliged to check possible damages and report them immediately to the delivery person, and to return delivered products with visible external damage. Otherwise, subsequent complaints will not be accepted.
The delivery of the product is considered to be the handing over of the products included in the individual order or subscription to the customer or to a third party designated by the customer.
We deliver all ordered products via the contracted courier service. The delivery price depends on the value of the ordered goods.
In the event that the customer for unjustified reasons refuses to receive the delivery of the product or does not pick up the product from the contracted delivery courier service and the product is returned to the address of Almagea d.o.o., Almagea d.o.o. has the right to charge the cost of returning the product from the customer in accordance with the valid price list of the courier service, and based on the proof of the incurred delivery cost and the invoice that Almagea d.o.o. issue to the customer on the basis stated, with a maturity of 15 days. In case of product return, the customer is obliged to send a justified complaint to the delivery person. The customer has the right to return the product in the following cases:
delivery of a product that was not ordered or included in the subscription
delivery of a product that has a fault or damage
if the consumer’s right to return the product is prescribed by mandatory regulations.
Please compare the received items with the invoice and if something is missing, immediately notify your delivery person.
In case you have a query or complaint regarding the purchase of products from our range electronically (Internet store and email order), please send it to almagea@almagea.hr. Almagea d.o.o. will respond to your inquiry or complaint as soon as possible, as well as take all reasonable measures to eliminate the reasons for which the complaint was sent.
The customer has the right within 14 days from the day of delivery of the one-time ordered products or, in the case of a subscription, from the day of the first delivery of the product, to unilaterally terminate the product purchase agreement / subscription agreement via the Internet store or by e-mail sent to almagea@almagea.hr, without giving a reason (“unilateral termination of the contract”). Upon expiry of the specified period, the customer loses the right to unilaterally terminate the contract.
In the event that the same delivery includes several pieces of products that are part of the same delivery, but are delivered to the customer separately or in several shipments, the term for unilateral termination of the contract starts from the day of delivery of the last shipment that is part of the same delivery. In the case of a subscription, all products delivered to the customer for a particular month of the subscription period are considered part of the same delivery.
The customer must notify Almagea d.o.o. on using the right to unilaterally terminate the contract before the expiry of the term for unilateral termination by a clear and unambiguous written statement sent by registered mail to the address of Almagea d.o.o.’s headquarters. or by email sent to almagea@almagea.hr, in which they will state their first and last name, address, contact phone number or address e-mail, the date of the order or subscription, and the name and quantity of the product for which the customer exercises the right to unilaterally terminate the contract. For unilateral contract termination, you can also use the declaration form that you can see in this document.
Almagea d.o.o. will without delay, to the e-mail address specified by the buyer in the declaration of unilateral termination of the contract or, if the buyer did not specify it in the declaration of unilateral termination, to the e-mail address of the buyer specified when ordering the product, will deliver to the buyer a confirmation of receipt of the declaration of termination.
In case of unilateral termination of the contract, the parties are not obliged to fulfill their obligations from the terminated purchase contract / subscription contract, i.e. they are required to return to each other everything they received on the basis of the contract unilaterally terminated by the buyer.
The customer must return the product without delay, and no later than within 14 days of sending the notice of termination given in accordance with these General Terms and Conditions. The customer bears the direct costs of returning the product to the address of Almagea d.o.o. headquarters.
It is considered that the Buyer has fulfilled the obligation to return the product on time if he sends the product to the address of Almagea d.o.o. and submit proof of sending the product to the headquarters of Almagea d.o.o. by electronic message sent to almagea@almagea.hr or if the product is personally delivered to the address of Almagea d.o.o. The customer is responsible for any reduction in the value of the product resulting from the handling of the product, except that which was necessary to determine the nature, characteristics and functionality of the product.
Almagea d.o.o. will refund the amount paid after the products have been returned, i.e. after the Customer has submitted to almagea@almagea.hr proof that he sent the products to the address of Almagea d.o.o. if the proof in question was submitted before receiving the product.
If the product is returned defective, with major damages or without parts and documentation, and if the same is not delivered within a subsequent period of 8 days, it is considered that the customer has not fulfilled his obligation to return the product and Almagea d.o.o. is not obliged to return the paid funds.
Almagea d.o.o. will not reimburse additional costs resulting from the buyer’s explicit choice of a type of transport that is different from the standard type of transport of products purchased electronically.
Almagea d.o.o. will refund the amount paid using the same means of payment used by the customer when paying, unless the customer expressly agrees to another means of payment and if the customer is not obligated to pay additional costs for such a refund.
The customer does not have the right to unilaterally terminate the contract if:
Almagea d.o.o. is responsible for material defects of products purchased via the Internet store, i.e. electronically in accordance with the Obligatory Relations Act and the Consumer Protection Act, in the currently valid text of those regulations.
In the event of a dispute arising from or in connection with the purchase of products through the Internet store, i.e. electronically, a report can be submitted to the Court of Honor of the Croatian Chamber of Commerce or a proposal for conciliation at the conciliation centers, in accordance with the rules of procedure of these bodies.
Almagea d.o.o. undertakes to protect the privacy and confidentiality of the personal data of its customers and users of the website, including the online store.
Almagea d.o.o., as a data processing manager, collects only those personal data that customers/users provide themselves and that are necessary to achieve the purpose for which they were provided.
Collected personal data is used for the purpose of selling products through the Internet store, i.e. electronically, delivering purchased products, responding to customer/user inquiries, contacting customers/users and improving our products and services, as well as for other related purposes. By submitting your personal data, you declare your consent to their collection, processing, use and, when an adequate level of personal data protection is guaranteed, forwarding in accordance with the goal and purpose for which they were submitted to us, as well as in accordance with positive national regulations.
All collected personal data is strictly protected and is available only to employees and business partners who need this data for the aforementioned purposes. All employees and business partners are responsible for respecting the principles of privacy protection and confidentiality of personal data.
If you have provided us with your personal data, you have the right to access that personal data and the right to correct it, as well as other rights provided for in the General Data Protection Regulation. Registration on the Internet store and purchase of products through it is possible as a guest or by opening the user profile, selecting the “My profile” option. You must be at least 18 years old and have legal capacity to register on the Online Store and purchase products through it. The customer is responsible for the accuracy and completeness of the data entered in the registration form. If you change the information you entered during registration, you must update your user account to inform us of the changes.
When registering on the Internet store, you will be required to create a username and password that you keep and do not share with other people. You are responsible for all promotions and orders placed under your password. If you know or suspect that someone else is using your password, you must notify us.
Almagea d.o.o. reserves the right to amend these General Terms and Conditions. We will notify all registered users of changes to the General Terms via the e-mail addresses they entered during registration. If you do not agree and do not accept these General Terms and Conditions, please contact us by email and during this time do not use the services of the Almagea Online Store or the possibility of ordering our products via e-mail.
Almagea d.o.o. strives to provide you with the best possible service, but we cannot guarantee that it will meet your needs. In addition, Almagea d.o.o. cannot guarantee that the service will be performed without possible errors. If an error occurs, please report it by email to almagea@almagea.hr so that we can eliminate it as soon as possible. Access to the Almage Online Store may sometimes be unavailable due to technical works.
